Welcome to Jugato! The terms "we", "us" and "our" refer to Jugato. Jugato operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a pleasant shopping experience (the "Services"). Jugato is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced herein (these "Terms of Service"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services. These Terms of Service do not limit any rights you may have under applicable consumer protection laws or any other non-waivable statutory rights.

1. Access and account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To use the Services, including browsing our store or purchasing our products, you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide it. We have made every effort to represent our products accurately in our store. However, colors and product appearance may differ from how they appear on your screen due to your device and its settings. Our play sets include balls in assorted colors, so the colors you receive may vary from those shown. Sizes and measurements are approximate. We do not warrant that the appearance or quality of any product will be exactly as depicted in our store. Product descriptions may change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantities we offer to any person, region or jurisdiction.

3. Pet safety and product use

Our products are toys for cats and other pets and are not intended for children. The balls are small. Always supervise your pet while it plays, and put the toys away when play is over. Do not leave your pet alone with the toys. Do not point the launcher at your pet's face or eyes, or at any person. Stop using any toy that is torn, broken or coming apart, and keep spare balls out of reach of pets and young children. If your pet shows any sign of discomfort, or swallows any part of a toy, contact a veterinarian immediately. You are responsible for deciding whether a product is suitable for your pet and for using it as intended. Nothing on our website is veterinary advice.

4. Orders

When you place an order, you are making an offer to purchase and authorize us and our payment processors to charge your selected payment method for the total amount of your order. Jugato reserves the right to accept or decline your order for any reason, subject to applicable law. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted. Please review your order carefully before submitting. If we do not accept, change or cancel an order, we will try to notify you using the email, billing address or phone number you provided.

Your purchases are covered by our 90-day money-back guarantee and are subject to return, refund or exchange in accordance with our Refund & Return Policy. This does not limit any rights you may have under applicable law. You represent and warrant that your purchases are for your own personal use and not for commercial resale or export.

5. Prices and billing

Prices are shown in US dollars. Prices, discounts and promotions are subject to change without notice. Promotional and launch prices are available for a limited time and may end at any time. The price charged for a product will be the price in effect when you place your order and will appear in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, customs or import charges, which are shown at checkout where applicable.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases. You represent and warrant that (1) you are authorized to use the payment method you provide, (2) the payment information you provide is true, correct and complete, (3) charges you incur will be honored by your payment provider, and (4) you will pay charges incurred at the posted prices, including all applicable taxes.

6. Shipping and delivery

Orders are processed within 1 to 3 business days. Delivery usually takes 4 to 8 business days after processing, depending on your country and city. All delivery times are estimates and are not guaranteed. Delays can be caused by shipping carriers, customs processing or events beyond our reasonable control, including natural disasters, severe weather, labor disputes, supply shortages, or governmental actions. We are not liable for delays caused by those events, but we will always try to keep you informed.

If your order does not arrive, or arrives damaged, please contact us at kermutienda@gmail.com and we will work with you to resolve it, including by sending a replacement or issuing a refund, as set out in our Refund & Return Policy.

7. Intellectual property

Our Services, including all trademarks, brands, text, images, graphics and video, are owned by Jugato, its affiliates or its licensors and are protected by U.S. and foreign trademark, copyright and other intellectual property laws. The purchase or delivery of any product does not grant you any intellectual property rights in the product, its design or its packaging. You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material on the Services without our prior written consent. Jugato's names, logos, product names, designs and slogans are trademarks of Jugato or its affiliates or licensors, and you must not use them without our prior written permission. Shopify's name and logo are trademarks of Shopify. All other names and logos on the Services belong to their respective owners.

The Services may give you access to tools or hyperlinks to websites provided or operated by third parties. We do not monitor or control them, and we provide access "as is" and "as available" without any endorsement. You use them at your own risk. We are not responsible for the content, accuracy, policies or practices of third parties, or for any harm related to your use of their tools, websites, products or services. Please review their terms before you engage in any transaction.

9. Relationship with Shopify

Jugato is powered by Shopify. When you use the Services, your device communicates with Shopify's systems to deliver them. However, any sales and purchases you make in our store are made directly with Jugato. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Jugato, including any injury, damage or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Jugato.

10. Privacy policy

Our Privacy Policy explains how we collect, use and disclose your personal information. By using the Services, you acknowledge that you have read it. Because the Services are hosted by Shopify, Shopify also collects, uses, processes and stores personal information about your access to and use of the Services, including your transactions, for purposes such as providing, securing and improving the Services and helping prevent fraud. If we cancel an order after payment has been collected, we will refund the full amount you paid.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL JUGATO OR OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. You agree to indemnify, defend and hold harmless Jugato, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service, (2) your violation of any law or of the rights of a third party, or (3) your misuse of the Services or of our products, including using them in a way that is not intended. We will notify you of any indemnifiable claim, provided that a failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced. You will cooperate in the defense of indemnified claims.

These Terms are governed by the laws of the jurisdiction where Jugato is headquartered or incorporated, without regard to conflict-of-law principles. You and Jugato consent to the jurisdiction and venue of the courts located in that jurisdiction, except where prohibited by applicable law. Nothing in this section limits any rights you may have to bring claims in your local courts or to rely on mandatory laws that apply where you live. By using the Services or placing an order, you agree that we may send you transactional and service-related communications electronically, including by email, about your orders, account, purchases, returns, these Terms of Service or other matters related to the Services.
